1. Acceptance of Terms

By accessing or using Punch (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including merchants who create loyalty programs and customers who participate in them.

2. Description of Service

Punch is a digital loyalty rewards platform that enables small businesses (“merchants”) to create and manage punch card loyalty programs. Customers participate by scanning QR codes, entering daily codes, and earning rewards set by the merchant. The Service is provided on a freemium basis with optional paid tiers for additional features.

3. Account Responsibility

You are responsible for maintaining the security of your account. Merchant accounts are authenticated via one-time passcodes sent to your email address or phone number. You must not share your access credentials or allow unauthorized access to your account.

Merchants are solely responsible for the rewards they offer, the accuracy of their loyalty program settings, and any obligations to customers created by their programs. Punch is not responsible for fulfilling merchant rewards.

4. SMS Communications

By providing your phone number and requesting a verification code, you consent to receive SMS messages from Punch containing one-time login codes. By enrolling in SMS notifications as a merchant, you consent to receive daily loyalty code messages.

You may opt out of SMS messages at any time by texting STOP. After opting out, you will receive a single confirmation message and no further messages. Text HELP for assistance or contact us at hello@usepunch.app.

Standard message and data rates may apply. Message frequency varies. Opting out of SMS notifications may limit your ability to use phone-based login.

5. Acceptable Use

You agree not to use the Service to violate any applicable law or regulation, send spam or unsolicited messages, attempt to gain unauthorized access to any part of the Service, or interfere with the operation of the Service.

Merchants may not use Punch to run fraudulent loyalty programs, misrepresent rewards, or collect customer information for purposes other than operating their loyalty program.

6. Intellectual Property

The Punch platform, including its design, software, and branding, is owned by Punch and protected by applicable intellectual property laws. You retain ownership of any content you provide, such as your business name and reward descriptions, and grant Punch a limited license to use that content solely to operate the Service.

7. Limitation of Liability

The Service is provided “as is” without warranties of any kind, express or implied. Punch does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

To the maximum extent permitted by law, Punch shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of revenue, data, or business opportunities.

8. Termination

You may close your account at any time by contacting us at hello@usepunch.app. Upon account closure, your data will be retained for a reasonable period before deletion, unless you request immediate deletion.

Punch may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any reason at our discretion. We will make reasonable efforts to notify you before termination except where immediate action is required.

9. Modifications to Terms

We may update these Terms of Service from time to time. We will notify you of material changes by updating the “Last updated” date at the top of this page. Continued use of the Service after changes constitutes acceptance of the revised terms.

10. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the courts of applicable jurisdiction.
